STAMP DUTY REBATE IN ENGLAND

Please read before considering a stamp duty refund.

In the case of Bewley v HMRC, the issue was whether the dwelling (a bungalow) was suitable for residential use at the time of completion. As the dwelling was not used as such at the point of completion, the question was whether the dwelling was SUITABLE for residential use at that time. 

 

The dwelling in this case had had the radiators and heating pipes removed and the presence of asbestos prevented repairs and alterations from being carried out. Therefore the tribunal found that the property was not suitable as a dwelling (uninhabitable) and so the lower non-residential rates would apply. 

 

Therefore, in order to apply for this stamp duty refund, the works carried out on the property must be more than just modernisation. An uninhabitable property is likely to lack basic facilities necessary for it to be lived in such as a functioning bathroom, kitchen and heating. 

*WARNING*

At the point of completion, was the property being used as or was the property suitable for use as a residential dwelling?
